A Tesla’s Failure to Detect an Obvious Hazard Can Support a Product-Liability Claim
A person can look ahead and immediately recognize a truck, stopped vehicle, pedestrian, or concrete barrier.
A Tesla’s driving software must complete several separate tasks:
- Detect that something is present;
- Determine what the object is;
- Decide whether it is in the vehicle’s path;
- Calculate distance and closing speed;
- Predict whether a collision will occur; and
- Warn, steer, or brake in time.
The cameras may record an object without the software recognizing it as a collision threat.
Low contrast, an unusual angle, bright glare, darkness, fog, faded lane markings, or an object that does not resemble the system’s training examples can interfere with detection and classification.
When that happens, the Tesla may continue steering, accelerating, or maintaining speed toward a hazard that appears obvious to the people around it.
A successful investigation focuses on what the vehicle detected, what it failed to detect, how its software interpreted the scene, and why it did not respond in time.
Tesla’s Camera-Only Design Is a Central Safety Issue
Tesla’s Full Self-Driving system relies on cameras and artificial-intelligence software to understand the roadway.
The National Highway Traffic Safety Administration describes FSD as relying “exclusively on vision-based cameras.” Tesla began moving away from a combined camera-and-radar system in 2021. Its consumer FSD system does not use LiDAR.
That design choice can become an important part of a Florida product-liability claim.
Cameras Depend on Light, Contrast, and Software Interpretation
Tesla’s cameras capture lane markings, traffic lights, signs, vehicles, and people. Their performance can be affected by:
- Sun glare;
- Darkness and low contrast;
- Fog, smoke, and airborne dust;
- Rain or snow;
- Dirty or obstructed cameras;
- Faded or conflicting lane markings;
- Unusual vehicle shapes;
- Stationary objects;

Sensor Redundancy Can Provide an Independent Safety Layer
Radar can independently measure distance and relative speed. LiDAR can create a three-dimensional representation of surrounding objects and their distance from the vehicle.
A product-liability investigation can examine whether additional sensing systems would have provided critical information when a camera or vision algorithm failed.
The investigation may also consider:
- Whether camera-only sensing was reasonably safe;
- Whether radar or LiDAR could have provided useful redundancy;
- Whether the software recognized uncertainty in its own perception;
- Whether Autopilot or FSD should have disengaged;
- Whether the Tesla should have reduced speed;
- Whether automatic emergency braking should have activated;
- Whether the system should have been restricted to particular roads; and
- Whether the driver received enough time to intervene.

Federal Investigators Have Documented a Recurring Crash Pattern
Concerns about Tesla’s ability to identify roadway hazards have appeared in federal crash investigations for nearly a decade.
Tesla Failed to Recognize a Tractor-Trailer Crossing the Highway
In 2016, a Tesla Model S operating with Autopilot struck the side of a tractor-trailer crossing a Florida highway. The impact sheared off the Tesla’s roof and killed its driver.
The National Transportation Safety Board found that:
- There was enough sight distance to avoid the crash;
- Tesla’s automated system was not designed to identify the crossing truck;
- Autopilot did not reduce the vehicle’s speed;
- Forward-collision warning did not alert the driver; and
- Automatic emergency braking did not activate.
The NTSB also found that Autopilot’s design permitted prolonged driver disengagement and overreliance on the technology.

Tesla Accelerated Toward a Stationary Fire Truck
In 2018, a Tesla operating on Autopilot struck a stationary fire truck in California.
The Tesla had been following another vehicle. When that vehicle changed lanes, the fire truck was exposed directly in the Tesla’s path.
According to the NTSB, Autopilot failed to recognize the hazard immediately and accelerated toward it. The Tesla issued a warning approximately half a second before impact. Automatic emergency braking did not activate.
The NTSB cited driver inattention, overreliance on automation, and an Autopilot design that allowed the driver to disengage from the driving task.

Autopilot Steered a Tesla Into a Highway Barrier
In 2018, a Tesla Model X operating on Autopilot steered into a highway gore area and struck a damaged crash attenuator at approximately 71 mph. The driver was killed.
The NTSB found that:
- Autopilot steered the Tesla out of the proper travel lane;
- The vehicle did not warn the driver that it was entering the gore area;
- The Tesla began accelerating toward the barrier;
- Forward-collision warning did not activate;
- Automatic emergency braking did not activate; and
- Limitations in Tesla’s vision-processing software contributed to the vehicle’s failure to maintain the correct path.

Autopilot Maintained Highway Speed Into Another Tractor-Trailer
In 2019, a Tesla Model 3 operating with Autopilot struck the side of a tractor-trailer crossing a Florida highway. The Tesla traveled beneath the trailer, its roof was sheared off, and the driver was killed.
Autopilot maintained a speed of approximately 69 mph until impact.
The NTSB reported that Tesla’s vision system did not consistently detect and track the trailer as an object or threat. Although that Tesla had cameras and radar, the system required agreement between the sensors before initiating automatic emergency braking. That agreement never occurred.

NHTSA Identified 211 Frontal Crashes Into Vehicles, Objects, or People
NHTSA conducted a major investigation into Tesla Autopilot after repeated reports of Teslas striking emergency vehicles and other roadway hazards.
The agency reviewed 956 crashes in which Autopilot was initially alleged to have been operating.
After separating incidents that could not be assessed or did not involve the investigated condition, NHTSA identified 467 crashes fitting three major patterns.
The largest and most serious category involved 211 crashes in which the front of a Tesla struck a vehicle, object, or person in its path.
Those crashes resulted in:
- 13 fatal crashes;
- 14 deaths; and
- 49 reported injuries.
In numerous crashes, the hazard had been visible for five seconds or longer. Yet drivers frequently did not brake or steer until less than one second before impact—or did not respond at all.
NHTSA found that Autopilot exercised substantial control while Tesla’s safeguards did not adequately keep drivers engaged.
The agency called this a “critical safety gap” between what drivers expected Autopilot could do and what it could actually do. NHTSA concluded that the gap led to foreseeable misuse and avoidable crashes.

Tesla Recalled More Than Two Million Vehicles
In December 2023, Tesla recalled approximately 2.03 million Model S, Model 3, Model X, and Model Y vehicles equipped with Autosteer.
Tesla acknowledged that Autosteer’s controls could be insufficient to prevent misuse in certain circumstances.
The software remedy was intended to:
- Make driver warnings more prominent;
- Reduce confusion about whether Autosteer was operating;
- Add checks on certain roads and near traffic controls; and
- Suspend access when drivers repeatedly ignored attention warnings.

In April 2024, NHTSA opened a Recall Query to examine the effectiveness of that remedy. The agency cited crashes occurring after the update and concerns about how portions of the remedy were implemented.

Current Federal Investigations Strengthen the Need for Independent Crash Analysis
FSD Performance in Glare, Fog, and Reduced Visibility
NHTSA is investigating whether Full Self-Driving can recognize when glare, fog, dust, or other conditions have degraded its ability to detect hazards.
The agency is examining whether FSD may continue operating without detecting its own reduced capability or warning the driver in time.
NHTSA identified nine crashes, including one fatal crash, when it upgraded the matter to an Engineering Analysis in March 2026.
The agency has demanded extensive information from Tesla concerning:
- Objects detected or missed;
- Camera recordings;
- Vehicle speed and planned path;
- Driver warnings;
- Automatic braking;
- Software and firmware versions;
- Driver-monitoring information;
- Internal testing; and
- Software changes made after previous crashes.

FSD Traffic-Signal and Wrong-Way Incidents
NHTSA is separately investigating reports of FSD-controlled vehicles:
- Proceeding through red traffic signals;
- Entering opposing lanes;
- Crossing double-yellow lines;
- Attempting to travel in the wrong direction; and
- Using marked lanes improperly.
At opening, that investigation covered approximately 2.88 million vehicles and identified 58 incidents, including 14 crashes and 23 reported injuries.

A $243 Million Verdict Demonstrated Tesla Can Share Responsibility
In August 2025, a Florida federal jury returned a landmark verdict arising from a fatal Autopilot crash.
The Tesla driver was distracted and failed to stop at an intersection. The Tesla, operating with Autopilot, struck a parked vehicle and two people standing nearby. One person was killed and another was seriously injured.
Tesla argued that the driver was solely responsible.
The jury found Tesla 33% responsible and awarded approximately $243 million, including $200 million in punitive damages.
The verdict demonstrated that a driver’s negligence does not eliminate a manufacturer’s responsibility for its own product design, operating restrictions, warnings, and safety decisions.
In February 2026, the federal trial judge refused to overturn the verdict or grant Tesla a new trial. Tesla’s appeal remains pending.

Multiple Autopilot Death Cases Have Ended in Confidential Settlements
The $243 million verdict is the most visible Autopilot result, but several additional wrongful-death cases have been resolved confidentially.
In April 2024, Tesla reached a confidential settlement with the family of an Apple engineer killed when his Model X, operating on Autopilot, was steered into a highway barrier. The settlement occurred immediately before trial.
In September 2025, Tesla entered confidential settlements in two additional California wrongful-death lawsuits involving fatal 2019 crashes and Autopilot. Both cases had been scheduled for trial shortly afterward.
At least three publicly reported Autopilot wrongful-death cases have therefore ended in confidential settlements, in addition to the $243 million jury verdict.
